Contract Schedule

Version:

v1.4

Effective date:

How the project-specific Contract Schedule, publication setting and Applicable Documents Register complete an ARK Kitchen contract.

ARK Project Contract Schedule

The ARK Project Contract Schedule is the private, project-specific contract document completed for an accepted ARK Kitchen project. A blank Schedule and blank Applicable Documents Register may be reviewed or downloaded publicly before a Client accepts a project.

1. Purpose

The Contract Schedule identifies the parties, Project, accepted Scope, price, payment stages, expected dates, responsibilities, publication setting and exact document versions applying to one Project Record.

It works with the applicable ARK Standard Kitchen Project Terms and the documents identified in the Applicable Documents Register.

2. Project-specific information

A completed Schedule may record:
the contracting Client and any Additional Client;
the Project address and authorised property owner;
the accepted Quotation, Drawing and Material & Hardware Schedule revisions;
the Contract Price and payment stages;
the expected production, installation and Handover windows;
included ARK work, Client responsibilities and other trades;
Special Conditions and accepted Variations;
the Project Publication setting; and
the applicable ARKCode after Project Activation.

3. Contract formation

A public website page, estimate, concept drawing, verbal discussion, blank template or unfinished Schedule does not by itself create a Project Contract.

The Contract becomes binding only in the manner stated in the applicable Kitchen Project Terms and completed Contract Schedule.

4. Document versions

The completed Schedule and Applicable Documents Register identify the governing document versions for the Project.

Later website updates do not automatically replace the versions accepted for an existing Project.

Accepted and superseded Project documents may be preserved in the Project Record and made available to authorised users through myARK.

5. Dates and programme

Expected dates and planning windows are recorded for the individual Project.

They remain subject to the accepted Scope, site readiness, approvals, material availability, other trades, Variations and the delay provisions in the applicable Contract Documents.

6. Project Publication choice
Before acceptance, the completed Schedule must identify either Standard Public Project Record or Confidential Project. Neither option requires separate approval by ARK. If no option is selected, the Project is treated as Confidential for public publication.
Where Standard Public Project Record applies, the authorised public information is limited to:
the suburb or general locality, without the street name, street number or exact address;
photographs of the completed Project;
the kitchen layout or general cabinetry configuration;
the accepted Project Scope and included work;
the materials, finishes, hardware and benchtop specifications used;
the final Project price including GST; and
the public Project Record reference assigned by ARK.
Where Confidential Project applies, ARK will not intentionally publish those categories through public or promotional channels unless the Client later gives separate written authorisation or disclosure is otherwise required or permitted by law.
The publication choice does not prevent private project photography and record keeping reasonably required for delivery, quality, safety, Handover, warranty, support, dispute management or legal compliance.
The publication authority does not provide public access to the Client's completed Schedule, private quotation, exact address, myARK account or restricted Project Record information.
Questions or requested corrections should be raised before signing or electronic acceptance. A later request concerning future publication or material on ARK-controlled channels will be handled under the Standard Terms and Privacy Policy.

7. Standard payment structure

Unless a signed project-specific Special Condition states otherwise, the standard kitchen payment structure is:
50% Project Activation Deposit, payable on Contract acceptance;
45% Cabinetry Installation Completion Progress Payment, claimable after Cabinetry Installation Completion is recorded, with Cleared Funds required before ARK authorises or releases custom benchtop manufacture; and
5% Final Completion Balance, claimable only after the included benchtop has been installed, Practical Completion has been achieved and ARK has recorded Handover.

The final 5% is not payable before benchtop installation. The completed Schedule records the amounts and any project-specific payment variation.
